Defendents in court now, one of them, video of the tree being felled was on his iphone, police found the phone in his pocket, he provided police with the passcode to the phone, wood from the tree found in his car boot, his car captured on CCTV on its way to and from the location. Not sure if I'm allowed to be serious for a moment (kind of), but I had to laugh out loud driving home with the news on the radio. One of the defendants, who strongly denied several times being at the crime scene, claimed he lent his car to lots of friends to use overnight, and often deliberately left his phone inside "to get away from it". What the judge said was "You will be released no later than 40% of the way through the sentence and the remainder of the sentence will be served on licence in the community" which I believe is nothing special. The max sentence under the guidelines for the tree offence appears to be 4 years. There was a second offence of damage to Hadrians Wall. His explanation of where he magicked up the additional 3 months from is a bit mysterious to me ... "The sentence on count 1 will therefore incorporate a part of the sentence on count 2, but not the whole of it. I have made a reduction to the sentence to be imposed on count 1 to reflect in Mr Carruthers’ case the absence of convictions and in Mr Graham’s case the absence of relevant convictions. Seems a moderately proportionate sentence to me given they've already spent 7 months and 1 month in prison already. It's a tree. And sycamores are weeds. And given that farmers along Hadrian's Wall have been nicking stones from it for the last 400 years, I don't think slightly squashing it under a tree is that bad. Having said that it's still more than you get for murdering someone, which is a disappointing reflection on our justice system. Reply to this message | Report message

When they get sentenced the judge takes account of however long they've already been banged up for and states how much time there is remaining to serve. Which leads me to wonder if someone has been held in custody then is found not guilty do they get compo? Reply to this message | Report message

There could I suppose be a case where the Crown acted totally egregiously in misusing evidence to persuade a court to refuse bail and then offer no evidence or such poor evidence that the judge threw the case out where compo might be justified but that's vanishingly rare. There are people on remand who claim to be innocent and have been so long on remand that the time there would equal their sentence should they be found guilty. There's another subset who are guilty and plead guilty but have been on remand long enough that they're discharged immediately. They then miss out on help thay should get on release and end up sleeping rough and potentially repeat offending - shoplifting - while waiting for benefits to kick in. The actual tariff, time that has to be served before being eligible for parole varies enormously between (say) mercy killing of a suffering spouse and something just short of whole of life will vary enormously. But less than these got for chopping down a tree seems v.low indeed. Or are we actually looking at a lesser offence but still with somebody dead. Reply to this message | Report message

A sycamore sprouting in a flower bed might be described as a weed. A much admired tree beautifully placed in the landscape assuredly is not.
