Of course if he had fully comp he would have abolsutely demanded a new battery pack.

There was a similar thing in the UK on a forum I read (might have even been here but a quick search didn't fnd it) on another make where the insurer wanted to repair a cracked battery pack but the owner got the manufacturer to insist the whole pack was replaced.
