I've just had a parking fine in a retail outlet park. 11 minutes over the two hour period. It is from a mob called Parking eye. £100.00
A. Does it have to be paid? If so see below.
B. I am currently awaiting what may be quite a big operation to correct a pharyngeal pouch (throat) where I keep having choking fits, and although the likelihood of actually choking is reasonably small, it stops me from basically doing anything due to constant coughing and throat clearing, not to mention eyes streaming. Would this stand up as any form of defence? Thoughts?

AIUI there is a 10 minute grace period to get back to your car. You might have been a bit longer than you would normally be due to your coughing fits?

Don't ignore it, since the Beavis case in the Supreme Court parking companies have been far more bullish about taking these cases to the County Court.
Use Parking Eye's review mechanism and if necessary appeal. They're part of the BPA which I think means the appeals are handled through POPLA which is professionally run by The Ombudsman Service.
Alternatively, if you just want to make it go away is there a reduced rate, often 50% off, if you settle it quickly?

1 Yes if you overstayed, were in breach of contract and have no grounds for appeal.
2 No unless unless sudden illness prevented your return to car on time in which case you could appeal but no doubt you would require medical evidence. Should you even be driving?

When it happens (and it is far from a regular occurrence) it is always when I've had something to eat or even drink and at no other times. So although I carry water in the car I don't consume any unless I am stopped. I was back at the vehicle in plenty of time, but had had a snack some 10 minutes before.................and then it started and just kept coming until it clears itself. It is a strange feeling.

If the carpark is in Scotland you can ignore invoices from the Parking Vultures!
Do not contact them and ignore the increasing invoices and threats of court action. After 6 months they give up.
The reason for difference with E&W is that the car owner is not liable in Scotland
If they do not know a name of the driver they cannot go to court - their threats are just that threats.
You still pay Police & Local Authority fines in Scotland -
How to tell the difference between £60 fines & £60 invoices?
Fines do not have VAT added.
Invoices will be showing £50 + 20% VAT £10 = £60 and have a VAT No on the invoice
