Srtictly speaking the ruling is about unlawful detention; the fact that detention was due to immigration status may be peripheral. Howver given the guy's antecedents it does look odd even from my perspective as the forum's resident lefty.
It's possible the full judgement might say more about the background and go some way to explain. Will have a look on Bailli when I get home.
