On our forums there are a lot of agency drivers who work on PAYE for one or more agencies.

They are sent to different firms to work on a daily basis, but almost never visit the agency offices.

There is a rumour going around recently that they are allowed to claim 45p per mile tax relief for their mileage travelling from home to their place of work.

I've expressed my doubts about this and I'm concerned that some are going to be facing a large bill when HMRC realise so many are doing this and decide to claim it back again.

I really would appreciate your opinion on this as they class the Agency offices as their regular place of work, but I'm not sure they can do this.

Mapmaker's view there seemed to be 'probably not' but I expect he'll be along shortly to clarify.

My advice to Mrs B, who has had the same offer as an agency teacher, was not to touch it with a bargepole.

Agreed.

A similar question arises in my work, as I have my own remote office and sometimes work from head office.

In my case. it would only amount to a few pounds either way, so I can afford to take the bargepole advice.

And as it's monthly expenses, there are always ways and means to make the money up elsewhere, if I did feel I was losing out.

Same for me. I'm based off Holborn but occasionally get sent to the main office in Westminster. If I go to HQ direct to/from home no claim as there's no difference (lesser of rule).

I can however claim my bus/tube fare or 25p a mile on the push bike for travel between sites.

This will be interesting for the drivers i know still doing the agency shuffle.

The allowance of 40ppm as far as i know has only been the preserve of those who have gone self employed on nova or similar schemes, and the few who have formed their own limited companies sometimes buy a vehicle in the company name and let it pay all the vehicle ex's including fuel.

Some agencies say they pay mileage allowance over a certain distance to their PAYE drivers as an incentive to take work miles away, in practice that's another politicians promise to get you on their books.

Cycle rate is actually 20p/mile not 25 as suggested above. Claims system is computerised and complicated so in practice I rarely bother.

My employers did the same with expenses.

The cynics among us - it's journalism so that's nearly everyone - thought management were hoping the complication of the system would reduce claims.

Grammatically incorrect, but I'm sure everyone gets the meaning.

There are one or two hand-wringing, leftie, social worker-type journalists who read the Guardian, if not write for it.

Actually, a lot of journalists are of the left politically, which is odd when you consider most newspapers lean to the right.

I did read the answers mapmaker gave to the thread a couple of weeks ago and it was what started me wondering about this but it left a few 'ifs' and buts'.

I thought if I gave him the exact situation it would clarify things for agency drivers.

I'm in the same game as mappy, so perhap I can answer.

Basically, no. Work does not begin until you reach the yard to pick up the lorry. Home to work travel is not allowable - there have been many cases in court/commissioners over the years. If interest I will try to look them up at work tomorrow.

The short answer is "it's complicated," and the other short answer is "not my area." Neither of those is much help to you.

A deduction is due for travel to a temporary workplace. i.e. anywhere that is not a permanent workplace www.hmrc.gov.uk/manuals/eimanual/EIM32065.htm

For your agency workers, the permanent workplace may be home, or the agency's office, or several of the yards you mention may all constitute permanent workplaces. Alternatively an entire area may constitute a permanent workplace www.hmrc.gov.uk/manuals/eimanual/EIM32190.htm

I imagine that the lorry driver only starts earning on reaching the site, and so does not have a travelling appointment. www.hmrc.gov.uk/manuals/eimanual/EIM32366.htm
