I joked on Friday after GE that I meet need a day's sick due PMSL.

Today the Supreme Court gave me reason to need another:

All the reasons rehearsed before the court were communicated to the Lord Chancellor by various august experts when fees were first mooted. Ken Clarke and Chris Grayling were too pig headed to take any notice....

Yes of course some claims are without merit but merit has next to no connection to ability to pay a fee equal to what is, for many people, a month's take home. What's needed is a process to weed out claims without merit at earliest opportunity. It just needs the processes to be put in place.

There was a scream of an interview on World at One about this with Charlie Mullins, boss of Pimlico Plumbers.

Very funny (and slightly disturbing) regardless of Charlie's comment on Jeremy Corbyn

Don't stop listening at 18 minutes when the interview with the Unison bloke starts. Charlie joins in again at about 20 minutes. At 23.50 he drags Brexit into it and calls Corbyn a twit (except the vowel was an 'a' not an 'i').

I agree it was completely wrong to bring in a £1,200 up front fee for a tribunal. Contrary to what Mullins thinks, I don't think people do it lightly.

Charlie says that as someone who employs 350 people he knows what he is talking about. Ironically he employs no-one, because all his workers are "self employed" despite the fact they have to get and use PP supplies, drive PP vans, wear PP uniforms, have PP phones, and get work from PP dispatchers.

They dont get PP sick pay or PP holidays!

Was a hoot - Charlie came across as an ignorant bully so I have no wonder he's against easier access to tribunals.

He didn't seem to get that it was nothing to do with EU law at all - not withholding access to justice dates back to Magna Carta

Seemed "naturally" wrong when it was announced.

Seems right that it has been overturned.

There will also be a lot of people for whom the fee genuinely prevented them claiming* and who's claims are now barred by the three month time limit to bring a claim.

There will be another scrap about whether they can issue proceedings out of time.

*I guess I see one or two CA clients in every session who have a potential ET claim. None are high earners so the fee is between 50 & 100% of their monthly take home (though household my have other income).
