A man who drove at up to 140mph the wrong way along a dual carriageway in Cornwall, causing a fatal crash, has been jailed for eight years.

Why has this case taken so long though?

The accident happened in Oct 2010.

He was charged in Feb 2011 then released on bail, and then attended court in April 2011.

He was given credit for his late guilty plea to having caused death by dangerous driving, but the judge said his previous convictions included one disqualification for drinking and driving in 2006 and another in 2008...

Judge Wassall said Rushbrook's judgement must have been impaired by tiredness, as he had been to work before embarking on a long journey, or the drug ketamine, a horse tranquiliser the defendant had admitted taking.

Banned for 10 years - why not life? 2 previous DD disqualifications in the 4 years up to the crash, and now this?

He'll never drive legally again. He's probably too stupid to be able to pass the extended driving test and will be uninsurable by anyone. Won't stop him driving though probably.

The minimum disqualification for causing death is an unbelievable 2 years.

There is no credit in waiting this long, and in what is clearly an attempt to reduce sentence, rather than genuine remorse.

A life ban may be counter productive and encourage illegal driving, with a ban of several years there is a hope of being legal one day. If he gives a toss anyway.

I dealt with a 2 lorry fatal. Not particularly complicated. It was nearly 2 years to the day for the final Magistrates Court case. Adjournment after adjournment. I think the main culprits where the insurance company who spun it out. They provided representation for the accused. Rather large claim on behalf of the deceased and a written off artic.

Assuming the suspect is arrested promptly, most murders, death by dangerous cases and the like take about a year from the date of the offence to when the defendant is sentenced.

This one's taken about 16 months, which is a bit longer than usual, but not much.

The page on the BBC website has been updated since I first posted the link.

Correction 7 March 2012: An earlier version of this story mistakenly said Rushbrook's car had been travelling at 140mph at the time of the crash. The story has been amended to make clear the combined impact speed was between 130 and 140mph.
