Do the courts really feel a lifetiome ban will mean anymore than a 99yr ban?

There is often a little gem in all these quotations from newspaper reports. This one has two!
1) His sentence was reduced by 2 months because he pleaded guilty early.
2) The sheriff said:
"Wake up and smell the coffee, Mr Winsborough."
A quaint legal expression, m'Lud.

Its a roundabout way of admitting the cupboard of punishment is bare.

Time to either chop his arms or legs off, or poke both eyes out with a blunt stick. That should stop him from driving again.

I hear that there is a vacancy for a Minister of Justice in Saudi, you should consider applying ;)

Seems a bit pointless, but perhaps there is some procedural reason for it.
At least there is a prison sentence involved, which will act as a further deterrent.
Always makes me laugh when they try to pretend that it was a one off incident, and that they just happened to get caught the one time they did it.
Either he's the unluckiest guy in Scotland, or he was probably driving every day since his last ban, and finally got caught.

I just had a thought - while he is in there, why dont they actually arrange driving lessons and get him to pass his test? 10 months should be enough, I expect by now he has the basics down. It would seem far more effective rehab than a lifetime ban although I suspect he would be back in for no insurance etc at some point.

I got the impression (could be wrong) that he was once qualified to drive, but just lost his licence for some reason, and then has continued to be caught driving while disqualified and re-banned.
A bit like a motoring version of that Charles Bronson guy (the prisoner, not the movie actor).

I wonder what he did all those years ago that got him a 99 year ban to begin with.
|
been disqualified since just before his 21st birthday
On 14 previous occasions he hasn't complied with that.
So he's been disqualified from driving since he was 20. I'd guess he's never taken a test, or perhaps ever held any type of licence, and was originally disqualified for that reason.

This guy is famous in Barlinnie prison for being a numpty. Not the sharpest tool in the shed. He says he's compelled to drive, he can't not drive and nothing will ever stop him.
My old man was a warder there for a few years and this guy came up in conversation a few years back.

...he can't not drive and nothing will ever stop him...
I've come across a few defendants who have previous drive while disqualified convictions in double figures.
Once the local plod know their face, it's almost inevitable.

If you read the Sheriff's remarks, he has a pop at govt for only allowing him to sentence for a maximum of 12 months.
He also says that an early guilty plea would be worth 3 months off the sentence but he was only getting 2 because a guilty verdict would have been inevitable.
I guess he wanted to send him down for a decent stretch.
If he goes to Bar-L he'll get a different kind of stretch...

"Winsborough appeared from custody and pled guilty at the first opportunity."
Shouldn't that be 'pleaded' guilty??? :-O
|
It's a Scottish Court so it is reported, correctly, that he "Pled" guilty.

For most people, a 99 year ban will be the same as a lifetime ban ~ unless they live to a really ripe old age!
