 Car owner wins court battle against clampers - Iffy
A car owner whose vehicle was clamped has won damages from the clampers.

I say car owner because part of this guy's case is he was not the driver of the car at the time, although he paid the release fees.

Yes, he would be unwise to order that new telly on the strength of the court's order.

I'm told clampers expect the occasional judgment against them and prepare accordingly.

Typically, the order will only be enforceable against a shell company with no assets.

The clampers carry on under the auspices of a new 'phoenix' company.

A lot of radio and consumer organisation comment on the nonsense that a person owed money can jump thru all the legal hoops at considerable financial outlay and then get an unenforceable CCJ at the end of it.

It is to be hoped the complainant in this case went into the process with his eyes open.

I suspect he did, and will be content with his victory in court and his story in the newspaper.

Anything else will be a bonus for him.

It would, although I suspect this lad represented himself, in which case most of his costs will be notional, so it's mostly his time.

There is a small fee to launch the action which he will have paid.

I see two photos on the front page of their website show disabled bays and double yellow lines - neither of which they have any power to enforce.

Could it be they are trying to establish a quasi-legitimacy in a bid to convince gullible members of the public to pay their fake tickets?
