 Bus Lane Transgression - scousehonda
On 28th October this year I received a 'Charge Certificate' from Liverpool City Council which stated that, on 24th August 2010, I drove in a bus lane in Lime Street and that 'a bus lane Penalty Charge Notice' was served on me and that I had failed to pay the Penalty Charge within 28 days of service. The Charge Certificate stated that the Council had decided to increase the penalty by 50% and that I must pay £90 within 14 days.

I do not dispute that I contravened the bus lane regulation, which has actually turned part of Lime Street (one of Liverpool's more famous thoroughfares) into a bus/taxi only stretch. I hardly ever drive in Liverpool these days and only realised that the change had occurred when I was at the point of no return.

The point at issue is that the original Penalty Charge notice was never received and I wrote to this effect the day that I received the 'Charge Certificate' (28/10/10).

So far I have received no further communication from the Council. Any suggestions as to whether I should follow the matter up or sit back and hope that they have decided to take pity on my ignorance of the new traffic arrangement. Is that an attitude likely to be taken by a local authority, particularly in the current financial climate?

My worry is that in letting the matter drag on I could be getting myself into deeper financial water.

I think I may have transgressed similarly a couple of weeks ago...signs are very small...:-(

Bad news tends to travel fast and well.

You've heard nothing, unless you think there might be a problem with your post generally, I would be inclined to leave things as they are.

No small number of local authorities still issue faulty documentation with regards to bus lane penalties.

Might be worth airing you question on Pepipoo forums where they have good knowledge on this matter.

That is to say you may have actually trangressed but the paperwok does not allow the authority to legally persue it. In some authority areas more than 60% of challenges succed.

Typical public servant uselessness.

Reading the Liverpool council website I think the way it works is that £90 is the amount of the fine. If you pay it within 28 days you get a 50% discount.

They have an appeals procedure an they are obliged to review all appeals. There is no cost for the appeal procedure so I don't think you can end up paying more than £90.

If I were you I would give them a ring.
