Record payout for serious injuries when a passenger in a car / lorry crash.
In cases like this if the injured woman had died from accident then the payout would have been minimal, she survived and requires 24x365 assistance.
|
i suppose its these massive payouts that puts everyones premiums up......not that i dont think she deserves it poor woman
|
Indeed. If she had died under the terms on my, and most other people's travel insurance, it would have been £10K tops for multiple limb loss and only 20k for death. At today's interest rates even 17.5 million won't generate that much to fund 24/7/365 care.

...At today's interest rates even 17.5 million won't generate that much to fund 24/7/365 care...
Four million straight away and £300,000 a year for life - nearly £1,000 a day.
I think she'll be able to rub along.
|
Sorry, but I find that remark about being able to 'rub along' quite offensive for someone with brain damage.
|
...I find that remark about being able to 'rub along' quite offensive for someone with brain damage...
Why?
Can't people with brain damage 'rub along' like anyone else?
I think you're discriminating against people with brain damage.
Very offensive.
(I don't really think that, I'm just trying to illustrate the flawed logic behind your comment.)
She has been awarded what by any standards is a vast amount of money.
I disagree with an earlier suggestion it may not be enough to pay for her care.
That's all.
|
Had some professional experience of these sort of cases. £300k a year buys quite a lot of nursing etc care but surprising how quickly things can get tight.
|
...but surprising how quickly things can get tight...
Don't doubt it.
But I don't think the court is saying this girl is entitled to a life of luxury purely because she has been grievously injured in an accident.
It is saying she is entitled to have a house purpose-built for her, and for her reasonable care needs to be met.
The more I think about it, the more I think 'rub along' is an appropriate comment, albeit not one the judge would use.
|
Note the £300k annual allowance is index linked.
There but for the grace etc, poor girl.
Genuine cases like this should have appropriate payments awarded.
|
The problem Iffy is that the 'rub along' comment does rather sound as though life will be easy. It wont.
|
OK.
I've given iffy an opportunity to justify his 'rub along' comment, now I'll justify my criticism.
I've dealt with some brain damaged people. Both those that have suffered damage from birth and those with subsequent damage.
I believe those that have damage from birth may have a little realisation of what they're missing.
I believe many of those that have subsequent damage have full awareness of what they've lost, but cannot express it. A bit like those with Alzheimers who have treatment and describe it as 'having a fog lifted'.
I believe nothing can compensate the latter for what they have lost.
I've no other criticism of iffy or what he does, but I believe his comments were unfair.
|
...I believe many of those that have subsequent damage have full awareness of what they've lost, but cannot express it...
I tend to agree, but that's not what we are talking about.
The only question is if £4m, plus £1,000 a day, index-linked for life, enough to look after someone who is unable to look after themselves?
I say it is, quite comfortably.
Whatever other problems this girl may face, money will not be one of them.
The term 'rub along' was nothing other than a simple way of saying money will not be a problem for her.
|
From personnal experince of having been involved in a motorway accident & suffered 2 years off work I can assure you no amount of compensation gives you back what you loose EVER !
If i could turn the clock back I would!
Even with more trivial injuries you still suffer with the side effects and concentration etc which in turn effects your own welfare.
No amount of money will ever give her or her family back what they had !
The term " rub along " was a very insensative remark ! afetr what her family would of gone through!
