2nd DD Offence in 3 yrs - almost 3 x over the DD limit
Given driving ban (again) + 160 hrs community service

I don't think anyone gets jailed for their 2nd DD offence.

Substantial fiscal and community penalties should be standard for DD.

Perhaps mitigated to a degree if they can be shown to deal with any drinking problem they have.

Wanton disregard for society where there is a lack of insurance, driving while disqualified, leaving the scene of an accident, etc would make it jailable in my view (with added fiscal/community penalty).

I think in Norway jail is standard for any DD offence - there is apparently a long waiting list between being sentenced and actually fulfilling the sentence due to the number of people involved.

Here is a real example of puny sentencing ;-)

incident happened after McKendrick shouted comments at an ex-girlfriend - there were bail conditions in place requiring him to stay away from her and avoid contact

When officers arrived to talk to him, they summoned reinforcements over concerns about the dog that was present.

When two colleagues arrived, McKendrick threatened to set the dog on them.

An armed response unit was called in after he issued further threats to shoot and stab them if they came near

McKendrick began to throw a number of missiles, including a glass ashtray, fork, ornament, bottle of shampoo and large container of salt towards them

He also admitted shouting, swearing and uttering threats towards police, throwing items and assaulting four officers by spitting at them


Yeah, 4.5 months seems fair. Not.
